General Provisions
These Terms and Conditions apply to purchases made in the online store www.nebshop.cz. Their purpose is to define the rights and obligations of the seller and the buyer (customer, consumer), in accordance with the laws of the Slovak Republic and the applicable legal regulations of the European Union.

All contractual relationships between the seller and the buyer are governed by the laws of the Slovak Republic and relevant EU regulations, especially:
- the Slovak Civil Code (Act No. 40/1964 Coll.)
- the Consumer Protection Act (Act No. 250/2007 Coll.)
- the Act on Consumer Protection in Distance Selling (Act No. 102/2014 Coll.)
- Directive 2011/83/EU on Consumer Rights
- Regulation (EU) No. 524/2013 on online dispute resolution for consumer disputes

Definitions
Consumer contract – a purchase contract concluded between a supplier and a consumer, where the consumer has not been able to influence the content of the pre-prepared terms provided by the supplier.
Seller (Supplier) – a person who, when concluding and fulfilling a contract, acts within the scope of their business or professional activity. The seller is a business entity offering or selling products or providing services to consumers.
Consumer (Buyer) – a natural or legal person who purchases goods or services for personal use or for the members of their household, and who does not act within the scope of a business or professional activity when concluding the contract.
Non-consumer Buyer – a person or entity that, when concluding and fulfilling the purchase contract, acts within the scope of their business or professional activity.
Terms and Conditions – contractual provisions between the seller and the buyer contained in this document. By submitting an order, the buyer confirms that they have read and agree with the currently valid Terms and Conditions, which become binding at the moment the purchase contract is concluded.
Formation of the Purchase Contract
The purchase contract is concluded upon the seller’s binding acceptance of the buyer’s order. The buyer places the order through email, the online order form on the seller’s website, or by phone (hereinafter referred to as the "order").
The order is considered accepted only when the seller explicitly confirms it by email or phone, after verifying the availability of the goods, the price, and the expected delivery date. An automatically generated confirmation of order receipt does not constitute a binding acceptance of the order.
The binding order confirmation includes a description of the ordered goods, the total price, buyer’s contact and delivery information, the method and cost of delivery, and any other relevant terms agreed upon by both parties.
Seller’s and Buyer’s Responsibilities
Seller’s Responsibilities
- Deliver the ordered goods in the agreed quantity and type, at the price valid on the date of dispatch, unless an obvious error or significant change in input costs has occurred.
- Ensure that the goods are properly packaged to prevent damage during transport.
The seller is not responsible for:
- Delays caused by the courier company.
- Delays due to an incorrect delivery address provided by the buyer.
- Failure to deliver due to supplier issues, revoked distribution rights, or other unforeseen circumstances beyond the seller’s control.
- The buyer’s dissatisfaction with their choice of goods, provided the goods match the description and are not defective.
Buyer’s Responsibilities
- Accept the ordered goods, check the packaging upon delivery, and immediately report any visible damage to the seller or courier.
- Pay the purchase price according to the payment terms valid at the time of order dispatch.
Right of Withdrawal
- If the seller cannot fulfill their obligations under the purchase contract due to stock depletion, unavailability of goods, discontinued production, or force majeure, they shall inform the buyer without delay and offer an alternative solution or allow the buyer to withdraw from the contract. In such cases, any payment already made will be refunded to the buyer within 14 days of the contract withdrawal notification.
- Statutory right (14 days): According to § 1829 of Act No. 89/2012 Coll., the consumer has the right to withdraw from a distance contract within 14 calendar days of receiving the goods. This right can also be exercised before the goods are delivered.
- Free shipping condition: If free shipping was used and the buyer returns all items, the standard shipping cost of the selected method will be deducted from the refund in accordance with § 1832(2) of the Civil Code.
- Extended return period (60 days): We voluntarily extend the return period to 60 calendar days for online purchases. Between days 15 and 60, returned goods must be unused, undamaged, complete, and preferably in the original packaging. In this case, a voucher will be issued instead of a cash refund.
- Refund method: Within the first 14 days, refunds will be issued using the original payment method within 14 working days of receiving the returned goods. From days 15–60, a voucher of equal value will be sent via email.
- How to withdraw: The buyer must send a written withdrawal to reklamace@nebbiashop.cz or deliver it in person/by post by the last day of the withdrawal period. The goods must be returned no later than 14 days after notification, along with the invoice and other included documentation. We recommend insured and trackable shipping.
- The withdrawal notice must include: full name, order number and date, product details, and the refund method (bank account or postal address).
- According to § 10(3) of Act No. 102/2014 Coll., the buyer is responsible for the cost of returning goods, including oversized items that cannot be returned by standard post.
- Non-returnable items: The right of withdrawal does not apply to goods unsuitable for return for health or hygiene reasons (e.g., underwear, swimwear). Such returns will not be accepted.
- Returns are only accepted for goods purchased from the NEBSHOP online store. Items purchased elsewhere will be returned to the sender with a processing and shipping fee.
- Returned goods must be complete, unused, in original condition with attached tags, and in the original packaging. A copy of the invoice must be included. Returns sent by COD (cash on delivery) will not be accepted.
- The seller will refund the amount paid within 14 days of receiving the withdrawal notice, but may withhold the refund until the goods are received or until proof of return is provided.
- The right of withdrawal does not apply to personalized or custom-made products intended specifically for one consumer.
- Withdrawal from the main contract also cancels any supplementary contracts. No fees may be charged for cancelling these if the services were not fully rendered. The seller is not obliged to refund extra delivery charges if the consumer chose a more expensive delivery method than the standard option.
- The consumer is liable for any reduction in the value of the goods caused by handling beyond what is necessary to determine the nature and functionality of the goods.
Warranty and Claims
All goods are covered by a statutory 24-month warranty starting from the date of delivery. The buyer must inspect the goods upon receipt and report any defects without undue delay.
If a defect appears within 30 days, we usually resolve the claim by replacing the item. Other claims are handled in accordance with applicable consumer protection laws.
Depending on the nature of the defect, the buyer may request:
- Repair
- Replacement
- Price reduction
- Withdrawal from the contract
Claims must be submitted using the claim form available on our website and the goods must be sent to our address in a clean and complete condition, ideally in the original packaging.
We resolve claims without unnecessary delay and no later than 30 days from the receipt of goods.
Please note that the warranty does not cover:
- Damage caused by improper handling or use
- Normal wear and tear
- Mechanical damage
Items purchased for business use are subject to warranty terms under commercial law.
Payment Terms
In the NEBSHOP online store, the buyer can pay for the goods using the following method:
- Prepayment – secure online card payment via payment gateway.
Additional payment methods may be available as listed during checkout.
The payment is considered completed only after the amount is credited to the seller’s account.
Delivery Terms
The delivery period starts from the day a valid order is received, including all necessary information. Orders are typically processed and dispatched within 1–2 business days.
If the ordered item is out of stock, the seller will promptly inform the buyer and offer an alternative solution — extended delivery time, replacement item, or cancellation of the order.
The buyer will be notified by email once the order is shipped. Final delivery time depends on the chosen carrier.
Privacy & Personal Data Protection
We process your personal data in accordance with Regulation (EU) 2016/679 (GDPR) and relevant national laws.
What data we collect
We process the following personal data provided voluntarily when placing an order:
- Name, surname, address, phone number, email (for individuals)
- Company name, registration number, VAT number, business address (for legal entities)
Purpose of processing
Your data is used to:
- Process and deliver your order
- Fulfill legal obligations (e.g., accounting)
- Send marketing emails (if you gave consent)
Retention period
Personal data is stored only for as long as necessary or as required by law.

Final Provisions
These Terms and Conditions apply as published on the NEBSHOP website on the date the order is placed by the buyer. The buyer confirms their acceptance by submitting the order.
The seller reserves the right to modify these Terms and Conditions. However, any order placed is governed by the version valid at the time of submission.
These Terms and Conditions are effective as of 1 November 2024.
